This policy describes how Brite (“Company” or “We”)  we may collect, use, share, retain and protect your Personal Information both online through this website (the “Website”) and offline with respect to information collected through trade shows and similar events.  This privacy policy applies to your Personal Information, which can include any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, your house, or your device (“Personal Information“).  Please note, the definition of Personal Information can vary by jurisdiction. If we collect information from you that is considered Personal Information in your jurisdiction, we will treat it as such in accordance with this Privacy Statement.  Our privacy practices are subject to privacy laws in multiple jurisdictions.  You may see references to practices that only apply to customers living in certain states.

2. Information our Privacy Policy Covers

This privacy policy applies to Personal Information the Company obtains in various contexts, both online and offline, including:

  • On this Website.
  • In email, and other electronic messages between you and Company;
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.
  • When you engage with us on social media;
  • When you engage with us at trade shows;
  • When you participate in our programs or events

It does not apply to information collected by Us offline other than as stated above. Our Website may have links to websites and/ or applications operated and maintained by third parties.  We have no control over the privacy practices of websites or applications we do not own and encourage you to review all third party privacy policies carefully.

3. Children Under the Age of 18

Our Website is not intended for children under 18  years of age. No one under age 18 may provide any personal information to or on the Website. We do not knowingly collect Personal Information from children under 18.  If we learn we have collected or received Personal Information from a child under 18, we will delete that information. We will not sell the Personal Information we collect. However, we will share it with third parties for cross-context behavioral advertising.  We do not collect sensitive Personal Information. Typically, we retain your Personal Information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. Please note that in many situations we must retain all, or a portion, of your Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, to protect against fraudulent, deceptive, or illegal activity, or for another one of our business purposes.

5. How We Collect your Personal Information:

We collect Personal Information about you from various sources, including:

  • Directly from you, such as:
    • Information that you provide by filling in forms on our Website or at trade shows.
    • Records and copies of your correspondence (including email addresses), if you contact us.
    • Your responses to surveys that we might ask you to complete for research purposes.
    • Your search queries on the Website.
    • When you interact with us at an event.
    • When you sign up to receive emails and/ or postal mailings.
  • Automatically, when you navigate through the Website, open or click on emails we send you or interact with our advertisements, such as.
  • From social media platforms/ networks. If you interact with us on social media or use features, such as plugins, widgets, or other tools made available by social media platforms or networks (including LinkedIn, Instagram, Facebook, Twitter, Google, You Tube, and Pinterest) in connection with our websites, we collect information that you share with us, or that the social media platforms share with us.   • Other Sources.   • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.

7. How We Use your Personal Information

We may use, share or disclose the Personal Information we collect for one or more of the following purposes:

We may share Personal Information with another company to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our customers and Website users is among the assets transferred.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

8. How We Sell or Share Your Personal Information

In addition to the specific situations already mentioned in this privacy policy, we disclose Personal Information in the following circumstances:

  • Service Providers. We share certain Personal Information with third parties that perform services to support our core business functions and internal operations including: fulfilling orders, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, administering our ratings & reviews, supporting beacons, processing credit card and debit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the Personal Information confidential, and prohibit using the disclosed information for any purpose except performing the contract.
  • Third Parties. We may share your Personal Information with third parties that we have partnered with to jointly create and offer a product, service, or joint promotion. If you decide to obtain a product or service that is offered by these third party partners, the information you provide will be shared with us and them. Please note, we will not share text messaging opt-in data and consent with any third parties for their marketing purposes. Some of our websites have features such as, plugins, widgets, or and other tools made available by third parties that may result in information being collected or shared between us and the third party.   • Legal Process. We may disclose Personal Information in response to subpoenas, warrants, court orders, government inquiries or investigations, or to comply with relevant laws and regulations. We may also disclose information to establish, exercise, or protect the rights of our company, employees, agents, and affiliates; to defend against a legal claim; to protect the safety and security of our visitors; to detect and protect against fraud; and to take action regarding possible illegal activities or violations of our policies.
  • Business Transfers. We may share Personal Information with another company that buys some, or all, of the assets or stock of Brite, and that company may use and disclose Personal Information for purposes similar to what is described in this policy. Brite may also share Personal Information with prospective purchasers to evaluate the proposed transaction
  • Other Instances. We may ask if you would like us to share your information with other third parties who are not described elsewhere in this privacy policy

9. How We Protect your Personal Information

We have implemented administrative, physical and technical safeguards designed to protect your Personal Information. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Website. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

10. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an email stating your request to privacy@brite.com.

Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to privacy@brite.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to transactional emails with respect to products or  services you have purchased.

Targeted Advertising.

You can also generally opt-out of receiving interest-based ads from third party advertisers who are members of the Network Advertising Initiative (“NAI”) or who follow the DAA Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website and DAA website.

When you opt-out using these methods, a cookie will be placed on your device indicating that you have opted-out of interest-based advertising. If you delete your cookies, you will need to opt-out again. These websites also provide detailed information about interest-based advertising and tips for managing your online privacy.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

 You may also send us an email at privacy@brite.com to request access to, correct or delete any Personal Information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

12. Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Website home page.  The date the privacy policy was last revised is identified at the top of the page. CALIFORNIA PRIVACY POLICY

This Privacy Policy for California Residents supplements the information contained in Brite’s general Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018, as amended (CCPA) and any terms defined in the CCPA have the same meaning when used in this Policy.

 

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months (the “right to know”). Once we receive your request and confirm your identity (please see “Exercising Your Rights to Know or Delete”), we will disclose to you:

  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose for collecting or selling that Personal Information.
  • The categories of third parties with whom we share that Personal Information.
  • If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:
    • sales, identifying the Personal Information categories that each category of recipient purchased; and

Right to Correct or Delete

You have the right to request that we correct or delete any of your Personal Information that we collected from you and retained, subject to certain exceptions (the “right to correct or delete”). Once we receive your request and confirm your identity (please see “Exercising Your Rights to Know or Correct or Delete”), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

We may deny your request to correct your information if we cannot verify your identity, correcting the information would conflict with federal or state law, if correction is impossible or involves disproportionate effort, or if we believe the request is fraudulent or abusive.

Exercising Your Rights to Know, Correct or Delete

Only you, or someone legally authorized to act on your behalf, may make a request to know, correct, or delete related to your Personal Information.

You may only submit a request to know twice within a 12-month period. Your request to know, correct or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

We will only use Personal Information provided in the request to verify the requestor’s identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at privacy@brite.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales Opt-Out and Opt-In Rights

If you are age 16 or older, you have the right to direct us to not sell your Personal Information at any time (the “right to opt-out”). Consumers who opt-in to Personal Information sales may opt-out of future sales at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize Personal Information sales. However, you may change your mind and opt back in to Personal Information sales at any time by emailing us at privacy@brite.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use Personal Information provided in an opt-out request to review and comply with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
